  80. ((MODERATORS' NOTE: As we reported in CuD #6.35 and previously,
  81. Amateur Action BBS in California has been the target of law
  82. enforcement activity for several years. When a local raid failed to
  83. produce anything illegal on the board, the US Postal Service ran what
  84. has been described as a sting/entrapment ploy to charge the sysop,
  85. Robert Thomas, with crimes that--while not violating California laws,
  86. allegedly violate Tennessee statutes.
  87.  
  88. The allegations raise questions of obscenity and child pornography.
  89. Because of their nature, such charges often fail to generate public
  90. awareness, let alone sympathy.  However, as reported earlier, the
  91. issues in this case bear directly on First Amendment rights in
  92. cyberspace.  One of the most important issues is: Can a file or image
  93. that is legal in one area of the US be subject to federal prosecution
  94. because it might violate statutes in another area? Does the fact that
  95. a person with a modem in Tennessee can transport files from a system
  96. in California subject the California source to federal prosecution,
  97. even though those operating the California system were not themselves
  98. responsible for transfering files into Tennessee? The Amateur Action
  99. BBS case raises many questions about judicial procedures, but the most
  100. disturbing issue is this:  If the prosecution is successful, it could
  101. set a precedent in which freedom of speech is subverted on the Nets by
  102. establishing as a standard the most restrictive criteria in a given
  103. jurisdiction and making it the de facto national standard).
  104.  
  105. I thought the folks who read alt.sex.* and the other places where this
  106. story has been posted might be interested in what an indictment for
  107. 50-60 years of jail time and a 2-3 million dollar fine looks like.
  108. Such a sensible use of tax money, and law enforcement effort!  (Hope
  109. you all feel safer now.)

  111. The thing which *really* steams me is that stuff on which the kiddy
  112. porn count (11) is based was described by the postal inspector at the
  113. time of the search as "sent without his (the sysop's) knowledge."
  114. Furthermore, the same postal inspector told me that sending folks
  115. unsolicited kiddy porn was "ordinary investigative procedure."
  116.  
  117. I have not bothered to look at the GIFs.  They are still posted on the
  118. BBS.  Nobody has requested that they be made unavailable even to the
  119. (unsophisticated?) people of western Tennessee.  I do know that
  120. descriptions of these things are "enhanced" (in such matters as
  121. relations) to or beyond the limits of the possible.  They are, after
  122. all, fantasy.

  124. This is a rough scan job.  The copy I have is not that good, my
  125. scanner is not the best at picking up this stuff, and I only spent a
  126. few hours fixing the errors.  Sorry, but I just can't take more time.

  160.                         COUNT 1
  161.     1.       Beginning at a date unknown to the Grand Jury, but at
  162. least in or about February, 1991, and continuing thereafter until
  163. on or about the date of this Indictment, in the Western District of
  164. Tennessee, and elsewhere, the defendants,

  168. did knowingly and wilfully combine, conspire, confederate and agree
  169. with each other and with other persons unknown to the Grand Jury,
  170. to commit certain offenses against the United States of America,
  171. that is:
  172.      (a)  to knowingly use and caused to be used an express company
  173. and  common  carrier, that  is, United    Parcel      Service  (UPS), for
  174.

  179. carriage in interstate commerce, obscene video cassette tapes; in
  180. violation of Title 18, United States Code, Section 1462;
  181.     (b)  to knowingly use and caused to be used a facility and
  182. means of interstate commerce, that is a combined computer/telephone
  183. system,  for  the  purpose  of      transporting  obscene  material  in
  184. interstate commerce; said obscene material being computer-generated
  185. images, referred to as a Graphics Interchange Format ("GIF") files;
  186. in violation of Title 18, United States Code, Section 1465.

  188.              FORM AND SUBSTANCE OF THE CONSPIRACY
  189.      2.   It  was  a  part  of      the  conspiracy  that,  in  or      about
  190. February, 1991, the defendants would establish a "computer bulletin
  191. board" at their residence, 475 Tramway Drive, Milpitas, California,
  192. using the name "Amateur Action Bulletin Board System" (AABBS).
  193.      3.   It  was  further  a  part  of  the  conspiracy  that    the
  194. defendants would utilize a "mail drop" service known as Mail Boxes,
  195. Etc.,  U.S.A.,    and  142  North  Milpitas  Blvd.  #284,  Milpitas,
  196. California  95035,  as  the  business  address  for  Amateur  Action
  197. Bulletin Board System.
  198.     4,       It  was  a  further  part  of      the  conspiracy  that  the
  199. defendants   would   utilize   interstate   telephone services   in
  200. conducting  their  computer  bulletin  board  system, using  specific
  201. telephone numbers including (408) 263--3393 and (408) 263-3396.
  202.      5,   It  was  a  further  part  of  the  conspiracy  that    the
  203. defendants, through the use of their computer bulletin board, would
  204. advertise  and    sell  obscene  video  cassette      tapes  and  obscene
  205.

  210. computer-generated  images  known  as  Graphics  Interchange  Format
  211. (GIF) files to members of the public, nationwide.
  212.     6.       It  was  a  further  part  of      the  conspiracy  that  the
  213. defendants would utilize an express company and common carrier,
  214. that is United Parcel Service (UPS), to distribute their obscene
  215. video cassette tapes to members of the public, nationwide.
  216.  
  217.      7.   Defendants  generally  used  the  following  method  of
  218. operation  in  conducting  their  computer  bulletin  board  (AABBS)
  219. business with members of the public:
  220.      Defendants  had  multiple      computers  and     'modems    at  their
  221. residence in Milpitas, California.   A     modem'  is a device which
  222. allows      the  transmission  and  receipt  of  computerized  data,
  223. interstate,  over  telephone  lines  between  computers.     Such
  224. transmissions are known as   uploads'  by the computer sending the
  225. data, and "downloads" by the computer receiving the data.  Through
  226. the use  of a "modem" any  person  who also had  a  computer  could
  227. "connect" their  computer  with  defendants   computer      by  dialing
  228. defendants'  business  telephone  number   and    logging   on    to
  229. defendants'  system.   Once ' logged  on   to  defendant s  computer
  230. system        a   person   could   review advertisements,   membership
  231. application requirements, and other information on defendants
  232. computer.  Once obtaining membership and an individual password, a
  233. person could, additionally,  'download   Graphics Interchange Format
  234. (GIF) files to his/her own computer, purchase video cassette tapes,
  235.

  240. magazines, and "GIF Packs" and, if the defendants desired, have a
  241. one-to-one  computer  conversation  with  the  defendants  through
  242. defendants' use of the "chat" mode.
  243.      To obtain membership to defendants' business (AABBS), a person
  244. had to complete an application and send a specified sum of money to
  245. defendants.  Defendants also allowed immediate membership to AABBS
  246. if  the  person  provided  credit  card  information (Master  Card  or
  247. Visa).      For approximately $55.00, a person was entitled to a six-
  248. month  access  to  defendants'  computer,  with  a  1.2  "megabyte"
  249. download  limit and a time limit of ninety (90) minutes per day.
  250. For  approximately  $99.00,  a      person      was  entitled  to  a  one-year
  251. access to defendants' computer, with the same download and  time
  252. limits as the six-month membership.
  253.  
  254.                 OBJECT OF THE CONSPIRACY
  255.      8.   It was a principal object of the conspiracy to carry out
  256. and  execute  the  abovesaid  business,  involving  distribution  of
  257. obscene material, utilizing the computer bulletin board system, for
  258. the  ultimate  personal  gain,      benefit,  profit,  advantage  and
  259. accommodation of the defendants and their co-conspirators.
  260.  
  261.                      OVERT ACTS
  262.      9        At all times hereinafter mentioned, during the pendency
  263. of the conspiracy, the following overt acts were engaged in, at
  264. least  one  of    which  furthered  and  effected  the  goals  of  said
  265. combination, conspiracy, confederation and agreement:

  273. (No.0098803083) styled "ROBERT A. THOMAS" with the Bank of America,

  276.      (b)  On  or  about  February  18, 1991,  defendant  ROBERT
  277. THOMAS signed a "Mailbox Service Agreement" with Mail Boxes Etc.,
  278. U.S.A., 142 North Milpitas Blvd., Milpitas, California 95035.

  280.     (c)  On  or  about  October  10,  1991,  defendant      ROBERT
  281. THOMAS opened a merchant account (No.4616510-1420-4937) with Peach
  282. Tree  Bancard  corporation,  2001  Butterfield  Rd.,  Downers  Grove,
  283. Illinois 60515.
